Machinists Pension Trust In a suit regarding the denial of distribution of pension benefits to a quasi-marital spouse, denial of the defendant's motion for reconsideration is affirmed where: 1) because of the quasi-marital relationship, the Superior Court's distribution order did in fact relate to "marital property rights"; 2) the spouse was an "Alternate Payee" under ERISA; and 3) the Superior Court's order qualified as a valid Qualified Domestic Relations Order.

In a patent case involving a drug-eluting expandable stent with a coating that has a non-thrombogenic surface, denial of defendant's motion for a new trial and judgment as a matter of law (JMOL) following a jury verdict of infringement of a patent claim is reversed where the district court erred as a matter of law in failing to hold the patent at issue to have been obvious.

Although drug store chain violated California's Labor Code section 432.7 by asking prospective employees whether they had been convicted of drug offenses in the preceding seven years, it is relieved of liability under abatement principles, because the Combat Methamphetamine Epidemic Act now expressly authorizes drug stores to pose such questions to their applicants "notwithstanding State law."
